Frequently Asked Questions
Under a contract for deed arrangement, the seller retains the title to the property until the buyer completes all payments. Nevertheless, the buyer is responsible for paying real estate taxes on the property, even though the tax is assessed against the seller.
Most properties owned by LandFix, LLC will be zoned as residential. Know this is part of your due diligence. Typically, the zoning map designates the area zoned with the letters “PD”; which stands for “planned development”. This is followed by a number used to reference the ordinance containing the regulations. The ordinance defines permitted uses, yard, height, bulk, and other regulations for the property, similar to any other zoning district. We find that rural properties do not have any zoning at all. With this being said, we strongly suggest checking with the county for zoning status.
There is a high probability that they will not be included. Why? Because many years ago sellers started to exclude these rights from the sale of their property or the mineral rights are under the ownership of the government or the railroad entities. This right was granted to these companies for building a bi-coastal railway system in the 1800s. Our offering will cite if they will or will not be included.
A warranty deed is a type of deed where the grantor (seller) guarantees that he or she holds clear title to a piece of real estate and has a right to sell it to the grantee (buyer).
First things first, yes, you should do it. Due diligence in real estate refers to a buyer’s investigation of the various aspects of a property, either before making an offer or (more often) within a specific timeframe between entering into the contract and closing, known as a due diligence period.
