Frequently Asked Questions

Who is responsible for paying property taxes while engaged in a Contract for Deed sale?2022-05-16T15:11:52-05:00

Under a contract for deed arrangement, the seller retains the title to the property until the buyer completes all payments. Nevertheless, the buyer is responsible for paying real estate taxes on the property, even though the tax is assessed against the seller.

How is the property zoned?2022-05-16T15:11:52-05:00

Most properties owned by LandFix, LLC will be zoned as residential. Know this is part of your due diligence. Typically, the zoning map designates the area zoned with the letters “PD”; which stands for “planned development”. This is followed by a number used to reference the ordinance containing the regulations. The ordinance defines permitted uses, yard, height, bulk, and other regulations for the property, similar to any other zoning district. We find that rural properties do not have any zoning at all. With this being said, we strongly suggest checking with the county for zoning status.

Are the mineral rights included with the property?2022-05-16T15:11:53-05:00

There is a high probability that they will not be included. Why? Because many years ago sellers started to exclude these rights from the sale of their property or the mineral rights are under the ownership of the government or the railroad entities. This right was granted to these companies for building a bi-coastal railway system in the 1800s. Our offering will cite if they will or will not be included.

What is a warranty deed?2022-05-16T15:11:53-05:00

A warranty deed is a type of deed where the grantor (seller) guarantees that he or she holds clear title to a piece of real estate and has a right to sell it to the grantee (buyer).

What does ‘due diligence’ mean and should I learn how to do it?2022-05-16T15:11:53-05:00

First things first, yes, you should do it. Due diligence in real estate refers to a buyer’s investigation of the various aspects of a property, either before making an offer or (more often) within a specific timeframe between entering into the contract and closing, known as a due diligence period.

Some of our properties will have a local agent that will assist you; however, most properties will not. We try extremely hard to create informational documents that are accurate and detailed. We strive to ensure that all of our brochures are as informative as possible so that you will have no problem finding the property and your way around.

At LandFix, we believe everyone should be entitled to simple property ownership. We welcome people with bad or no credit and do not charge any closing costs whatsoever for purchasing a property. We do not require buyer qualification to purchase a property and once you have signed the contract and made your down payment, interest in the property beings. Per the terms of our financing agreement, you are welcome to full use and enjoyment of the property during the time you are making monthly payments. Once the balance has been paid in full, the deed will be notarized and sent to the circuit clerk for recording the same day

Every property is different and we offer various payment term options on each of our properties, depending on several factors. Please check the individual property listing page for specific terms and payments offered for that listing.
