USE OF LANDFIX.COM
You may use Landfix.com only for lawful purposes and in accordance with these Terms. You agree not to use Landfix.com:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
- To impersonate or attempt to impersonate Landfix.com, a Landfix.com employee, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Landfix.com, or which, as determined by us, may harm Landfix.com or users of Landfix.com or expose them to liability.
ACCOUNT REGISTRATION
In order to access certain features of Landfix.com, you may be required to register for an account. You agree to provide accurate and complete information when creating your account, and to update your account information as needed to keep it accurate and complete. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Landfix.com immediately of any breach of security or unauthorized use of your account. Landfix.com will not be liable for any losses caused by any unauthorized use of your account.
PURCHASING LAND
When purchasing land on Landfix.com, you agree to pay the listed price for the land, as well as any applicable taxes and fees. You also agree to provide accurate and complete information for the purchase, including your payment information. Landfix.com reserves the right to cancel any order if we believe the information provided is inaccurate or incomplete.
REFUNDS AND RETURNS
Land purchases on Landfix.com are final and are not eligible for refunds or returns. If you have any issues with your land purchase, please contact our sales and operations manager, Chris Custer at (469) 305-8386 to discuss your concerns.
DISCLAIMER OF WARRANTIES
Landfix.com is provided on an “as is” and “as available” basis. Landfix.com makes no representations or warranties of any kind, express or implied, as to the operation of Landfix.com or the information, content, materials, or products included on Landfix.com. To the full extent permissible by applicable law, Landfix.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Landfix.com will not be liable for any damages of any kind arising from the use of Landfix.com, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
LIMITATION OF LIABILITY

INDEMNIFICATION
You agree to indemnify and hold Landfix.com and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of Landfix.com, your violation of these Terms, or your violation of any rights of another.
GOVERNING LAW
These Terms and your use of Landfix.com will be governed by and construed in accordance with the laws of the state of Texas, without giving effect to any principles of conflicts of law.
DISPUTE RESOLUTION
Any dispute, controversy, or claim arising out of or relating to this contract, or the breach thereof, shall be finally settled by arbitration.
SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions of these Terms will remain in full force and effect.
WAIVER
No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and Landfix.com’s failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.
ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Landfix.com and govern your use of Landfix.com, superseding any prior agreements between you and Landfix.com.
CHANGES TO THESE TERMS
Landfix.com reserves the right to update and change these Terms from time to time without notice. Any changes will be effective immediately upon posting to Landfix.com. Your continued use of Landfix.com after any changes are made will constitute your acceptance of the revised Terms.
